Terms of sale

1. Scope and seller

These terms of sale govern the purchase of digital photographs on sidmarin.com, published by Sid Marin, sole trader registered in France : 6 bis chemin de Montestruc, 64340 Boucau, France - SIREN 898 461 603 : contact: sidmarin.ph@gmail.com.

Placing an order on this site implies full acceptance of these terms.

2. Products

The site sells high-resolution digital photographs taken at events and grouped into private galleries accessible via direct link. Previews displayed on the site are watermarked; the files delivered after purchase are not.

3. Pay-what-you-want pricing and payment

Pricing is free: the buyer chooses the amount for their entire selection, with a symbolic minimum of €1. Prices are inclusive of tax : VAT not applicable, art. 293 B of the French Tax Code (CGI).

Payment is made by card through the secure Stripe platform. No banking data passes through or is stored on this site. The order is confirmed once Stripe validates the payment.

4. Delivery

Delivery is immediate: once payment is confirmed, the confirmation page displays individual download links - single-use, valid for 24 hours : plus a bundled ZIP download.

If anything goes wrong (expired link, missing file, failed download), contact sidmarin.ph@gmail.com and new links will be provided free of charge.

5. Right of withdrawal

The photographs sold are digital content supplied immediately after payment, without any physical medium. By confirming their order, the buyer expressly requests immediate performance and acknowledges that, in accordance with article L221-28, 13° of the French Consumer Code, they waive their right of withdrawal once the download begins.

6. Usage licence

The purchase grants the buyer a personal, non-exclusive, non-transferable licence over the purchased photographs, allowing: private use (personal printing, archiving) and sharing on their personal social media accounts.

This licence excludes: any commercial, advertising or promotional use, resale or transfer to third parties, and any use harmful to the people photographed. The photographer retains full copyright (art. L111-1 of the French Intellectual Property Code). Crediting “© Sid Marin” when sharing is appreciated, though not required.

7. Complaints and mediation

Any complaint may be sent to sidmarin.ph@gmail.com and will be answered as soon as possible.

In accordance with articles L611-1 et seq. of the French Consumer Code, consumers may use a consumer mediation service free of charge to resolve a dispute amicably. The details of the mediation scheme the seller belongs to will be specified here and are available on request.

The European online dispute resolution platform is available at ec.europa.eu/consumers/odr.

8. Governing law

These terms are governed by French law. Any dispute not resolved amicably falls under the jurisdiction of the French courts under ordinary law, without prejudice to mandatory consumer protections applicable in the buyer's country of residence.
